1. Agreement to Terms

By accessing or using AfghanDiaspora.store ("the Platform", "we", "us", "our"), you agree to be bound by these Terms & Conditions and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use the Platform. These Terms apply to all visitors, buyers, sellers, and any other users of the Platform.

2. Description of Service

AfghanDiaspora.store is an online marketplace platform that connects buyers worldwide with sellers of authentic Afghan products including, but not limited to, clothing, handmade crafts, dry fruits, spices, and gemstones. We act solely as a marketplace facilitator and are not a party to any transaction between buyers and sellers.

3. User Accounts

To buy or sell on the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and accept all risks of unauthorized access
• Promptly notify us of any unauthorized use of your account
• Not create accounts for fraudulent or deceptive purposes
• Be at least 18 years of age to create an account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Seller Obligations

Sellers on AfghanDiaspora.store agree to:

• List only authentic Afghan-origin products
• Provide accurate descriptions, images, and pricing
• Ship orders promptly and provide tracking information
• Respond to buyer inquiries within 48 hours
• Complete Stripe Connect account setup before listing products
• Comply with all applicable export/import laws and regulations
• Not list counterfeit, prohibited, or misrepresented goods

Sellers who violate these obligations may have their listings removed and accounts suspended without notice.

5. Platform Fees

AfghanDiaspora.store charges sellers a platform fee of 10% on each completed transaction. This fee is automatically deducted from the transaction at the time of payment via Stripe. Stripe's own processing fees (approximately 2.9% + $0.30 per transaction) are separate and charged by Stripe directly. Fees are subject to change with 30 days' notice to sellers.

6. Payments

All payments are processed securely by Stripe. AfghanDiaspora.store does not store credit card or banking information on its servers. By making a purchase, you agree to Stripe's Terms of Service. We reserve the right to cancel any transaction that appears fraudulent or in violation of these Terms.

7. Prohibited Uses

You may not use the Platform to:

• Violate any applicable local, national, or international law or regulation
• Transmit any unsolicited commercial communications
• Impersonate any person or entity or misrepresent your affiliation
• Engage in money laundering or any other financial crime
• List or sell weapons, narcotics, counterfeit goods, or prohibited items
• Scrape, harvest, or collect user data without consent

8. Intellectual Property

All content on AfghanDiaspora.store — including the logo, brand name, design, text, and software — is the intellectual property of AfghanDiaspora.store and may not be reproduced, distributed, or used without written permission. Sellers retain ownership of their product images and descriptions but grant AfghanDiaspora.store a non-exclusive license to display them on the Platform.

9. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. AfghanDiaspora.store does not warrant that the Platform will be uninterrupted, error-free, or free of viruses. We do not endorse or guarantee the quality, accuracy, or authenticity of any seller listing.

10. Limitation of Liability

To the maximum extent permitted by law, AfghanDiaspora.store shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, or from any transactions between buyers and sellers. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Dispute Resolution

Any dispute between a buyer and seller is primarily between those parties. AfghanDiaspora.store may, at its discretion, assist in mediating disputes but is not obligated to do so. Any legal dispute involving AfghanDiaspora.store shall be governed by applicable law and resolved through binding arbitration, except where prohibited by law.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify registered users of material changes by email or a prominent notice on the Platform. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
